Acting under the orders of General Jessup, General Hernandez met with the Seminole leader Osceola, in the vicinity of St. Augustine, under a flag of truce. Hernandez, still obeying Jessup, ordered his troops to surround Osceola and the other Seminoles accompanying him. The captives were then imprisoned in Ft. Marion. Osceola, five other chiefs, 116 warriors, and 82 women and children were moved to Ft. Moultrie at Charleston, S.C. by late December of that year. Osceola died January 31, 1838, at Ft. Moultrie of quinsy aggravated by malaria.
